DeCSS decision under review California's Supreme Court voted last week to review the DVD Copy Control Ass'n v. Bunner case. In that case, the Sixth District Court of Appeal (San Jose, CA) held the dissemination of DeCSS - the code that breaks DVD copy protection - is constitutionally protected free speech, deserving of more protection than trade secrets: "DeCSS is a writing composed of computer source code which describes an alternative method of decrypting CSS-encrypted DVDs. Regardless of who authored the program, DeCSS is a written expression of the author's ideas and information about decryption of DVDs without CSS." By granting review, the CA Supreme Court has the opportunity to reverse the appellate court's decision and reinstate the trial court's injunction.
